Competition conditions of participation Facebook

These conditions of participation apply to the competition on https://www.facebook.com/amevida.deutschland/ from 19.01.2024. Participation is free of charge. By participating, you expressly accept the conditions of participation.

Organizer

The organizer of the competition is AMEVIDA SE, Kurt-Schumacher-Straße 100, 45881 Gelsenkirchen, Germany, hereinafter referred to as the "Organizer" or "AMEVIDA".

This competition is in no way connected to Facebook and is in no way sponsored, supported or organized by Facebook and does not establish any legal claims against Facebook. The recipient of the information provided by the participant is not Facebook, but the organizer. The organizer is solely responsible for the organization and implementation of this competition. All inquiries, comments or complaints about the competition should be addressed to the organizer, e.g. by email to marketing@amevida.de.

Competition

The competition starts on 19.01.2024 and ends on 21.01.2024, 24:00. The start of the competition will be published in the form of a competition post on the named Facebook account of AMEVIDA. Messages received after the end of the competition will not be included in the draw.

After the end of the competition, the following prize will be drawn from all participants in accordance with the conditions of participation:

2 times 2 tickets for the upcoming home game of the VfL Sparkassenstars against the FRAPORT SKYLINERS on 27.01.2024.

Participation

Any natural person who is at least 18 years old at the time of participation, has a Facebook account, is resident in Germany and agrees to these conditions of participation is eligible to participate. Prizes will not be distributed to minors.

For successful participation, the participant must follow the channels of AMEVIDA and VfL SparkassenStars Bochum within the competition period and send a personal message to AMEVIDA. Multiple entries by a single person do not increase the chances of winning and count as a single entry.

The organizer reserves the right to exclude persons from participation at its own discretion if there are justified reasons, for example:

(i) manipulation in connection with access to or the execution of the competition,

(ii) breaches of the conditions of participation,

(iii) acting unfairly; or

(iv) providing false or misleading information in connection with participation in the competition.

Implementation and handling of the competition

The date on which eligibility and the prize draw are determined is the working day following the closing date for entries. The winner will be drawn by lot and will receive the above-mentioned prize. As soon as the winner has been determined, he or she will be notified of the prize by personal message on Facebook and asked to report back as soon as possible, stating his or her real name, e-mail address and date of birth. AMEVIDA reserves the right to request proof of age. If a winner does not respond in time to receive their prize after being notified, the prize will be forfeited and a replacement winner will be chosen. The prize is non-transferable. The prize cannot be converted into a cash payment and cannot be exchanged. The prize will be sent to the winner by e-mail. The prize will be sent promptly to the address provided. If the prize cannot be delivered, another winner will be drawn. Any complaints must be sent to AMEVIDA in writing within 14 days of the reason becoming known, stating the competition. Complaints communicated by telephone, complaints via a comment on Facebook or late complaints cannot be processed.

Warranty and liability

We would like to point out that the competition and the prize are voluntary services on our part.

We are not liable for items won, subject to our own fault in accordance with the provisions in the liability information in these conditions of participation.

The prize listed may differ from the prize presented to the winner, provided that it is equivalent in terms of the characteristics described.

The following exclusions and limitations of liability apply to our liability for damages, notwithstanding the other statutory requirements for claims.

Insofar as liability on our part is excluded or limited, this also applies to the personal liability of our employees, representatives and vicarious agents as well as to the liability of any sponsors. We are liable for the slightly negligent breach of essential obligations, the breach of which jeopardizes the achievement of the purpose of the contract, or for the breach of obligations, the fulfilment of which is essential for the proper execution of the competition and on the observance of which the contractual partners regularly rely (so-called cardinal obligations). In this case, however, we shall only be liable for the foreseeable damage typical for the contract. We are not liable for the slightly negligent breach of the obligations mentioned in the above sentences by others. We shall be liable without limitation insofar as the cause of the damage is based on intent or gross negligence. In the event of a grossly negligent breach of duty by our vicarious agents, the aforementioned limitations shall apply to the slightly negligent breach of material duties.

The above limitations of liability shall not apply in the event of injury to life, limb or health, for a defect following the assumption of quality guarantees for the quality of a product and in the event of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.

Miscellaneous

Legal recourse is excluded with regard to the drawing of the winners. These conditions of participation and the entire legal relationship between the participants and the organizer are subject exclusively to the law of the Federal Republic of Germany. Should individual provisions of the conditions of participation be or become invalid, the validity of the remaining conditions of participation shall remain unaffected. The organizer reserves the right to change the competition at any time without prior notice and without giving reasons (e.g. the conditions of participation) or to terminate it if the proper execution of the competition cannot be guaranteed due to fraud, technical reasons or other reasons beyond the control of the organizer. Participants cannot derive any claims from this. If an interruption or termination is due to the behavior of a participant, the organizer is entitled to demand compensation from this participant for the resulting damages.
